Terms of Service – Lena & Rose Hampton
Article 1 – Definitions
In these Terms of Service, the following definitions apply:

Cooling-off period: the time frame in which the consumer can exercise their right of withdrawal.

Consumer: any natural person acting for non-professional purposes who enters into a distance contract with the seller.

Ongoing contract: a distance contract concerning a series of products or services supplied over time.

Right of withdrawal: the consumer’s right to cancel the distance contract within the cooling-off period.

Seller: the legal entity or individual offering products or services to consumers at a distance.

Distance contract: an agreement concluded between the seller and the consumer via an organized system for remote sales or services.

CESOP: the Central Electronic System of Payment Information used by the European Commission to monitor payment service providers.

Article 3 – Scope of Application
These Terms of Service apply to all offers from the seller and any distance contract concluded between the seller and the consumer.
Before completing a purchase, these terms are made available electronically and can be stored or printed by the consumer.
Article 4 – Offers
All offers are non-binding.
The seller reserves the right to modify or withdraw offers at any time.
Every offer includes a clear description of the product, total cost (including shipping fees, import duties, and any additional charges), and currency.
Article 5 – Contract Formation
A contract is established once the consumer accepts the offer and fulfills the required conditions.
The seller confirms the order receipt via email.
The consumer is responsible for providing accurate contact and shipping information.
Article 6 – Right of Withdrawal
The consumer has the right to withdraw from the contract within 30 days of receiving the product, without stating a reason.
Return costs are the responsibility of the consumer.
Products must be returned in unused and original condition, with packaging intact.
Returns may be directed to the original shipping location, which may be outside the consumer’s country (e.g., supplier warehouse in China).
Article 7 – Refunds and Withdrawal Costs
Refunds are processed within 30 days of withdrawal, provided the returned product has been received and inspected.
Original shipping costs and import-related charges are non-refundable.
Article 8 – Customs, Import Taxes, and Duties
8.1 All shipments are made under DDU (Delivered Duty Unpaid) terms.
8.2 The customer is solely responsible for:

Paying VAT, import duties, or other local taxes;

Any customs clearance or brokerage fees;

Compliance with local import regulations.
8.3 The seller is not the official importer. Ownership of goods transfers to the customer upon shipment.
8.4 Necessary documentation (e.g., pro forma invoice) will be provided; however, the customer must ensure full import compliance.
8.5 The customer agrees to indemnify the seller from any claims, delays, or costs resulting from non-compliance with local customs or import laws.
8.6 Customers are strongly encouraged to check local regulations prior to placing an order.
Article 9 – CESOP Compliance
In accordance with EU regulations, payment service providers are required to report cross-border transactions via the CESOP system.
Lena & Rose Hampton complies with this reporting framework as mandated by law.
Article 10 – Product Conformity and Warranty
The seller guarantees that all products conform to the agreement and meet reasonable standards of quality and usability.
Any defects or non-conformities must be reported in writing within 15 days of delivery.
Products must be returned to their original shipping location in unused condition and original packaging.
Article 11 – Delivery
Orders are typically delivered within 30 days, unless otherwise stated.
If a delay occurs, the consumer will be notified within 15 days.
The consumer is responsible for import clearance and any associated costs.
Refunds will not be issued for delays or non-delivery caused by customs or import issues.
Article 12 – Complaints
Complaints must be submitted in writing via email to info@lenarosehampton.com within 15 days of receipt.
The seller will respond within 14 days of receiving the complaint.
If additional investigation time is needed, the consumer will receive an acknowledgment and estimated resolution timeline.
Article 13 – Legal Disputes
These Terms of Service are governed by the laws of the Netherlands.
Both parties will first attempt to resolve disputes amicably.
If no resolution is reached, disputes shall be submitted exclusively to the competent Dutch courts.
